Terms governing your use of Mend.

1. Agreement to these Terms

These Terms and Conditions, together with the Privacy Policy and any specific terms shown at a purchase or product page, form the agreement between you and Mend Mental Wellness concerning the Services.

By accessing or using the Services, you confirm that you have read and understood these Terms and agree to them. If you do not agree, do not use the Services.

If you use the Services for or on behalf of another organization, you confirm that you have authority to bind that organization. References to “you” then include that organization.

2. Eligibility and age

You must be legally capable of agreeing to these Terms. Mend resources are intended for adults. If you are under 18, use the Services only with the knowledge and permission of a parent or legal guardian and, where appropriate, guidance from a qualified professional.

Mend does not knowingly invite children to submit personal information, trauma histories, diagnoses, crisis details, or private worksheet content.

3. The Services

Mend provides general educational and self-support resources. Depending on the page or product, these may include educational videos, bilateral visual or audio stimulation, preparation and reflection worksheets, grounding and aftercare prompts, journaling structures, printable materials, downloads, and email updates.

The Services are designed to support private, user-controlled reflection. They are not designed to evaluate you, monitor you, determine your diagnosis, select treatment, or provide individualized clinical recommendations.

6. Suitability and self-directed use

You decide whether, when, and how to use a self-support resource. You may pause, stop, look away, remove headphones, close the page, use grounding, or seek support at any time.

Mend does not determine whether a resource is appropriate for a particular person. Seek advice from a qualified professional before using a resource if you are uncertain about suitability, are currently unstable, have a condition that may affect safe participation, or have previously experienced severe distress, dissociation, seizures, sensory sensitivity, or another adverse reaction during similar practices.

This list is not a clinical screening tool and is not complete. The availability of a Mend resource does not mean that it is appropriate or safe for every person or circumstance.

Do not use the Services while driving, operating machinery, supervising a safety-critical task, or in another situation requiring continuous external attention.

7. No promised outcome

Individual experiences vary. Mend does not promise or guarantee that the Services will reduce symptoms, process or resolve a memory, heal trauma, treat PTSD or CPTSD, prevent deterioration or crisis, or produce a particular emotional, cognitive, physical, or functional result.

Mend does not guarantee that a resource will be suitable, effective, uninterrupted, complete, or error-free for every person.

8. Privacy and local worksheet data

Your use of the Services is also governed by the Privacy Policy.

The Safe Start Worksheet is designed so that worksheet answers save locally in your browser on your device. Mend is designed not to receive or read those entries. Clearing browser data, using another browser or device, or changing storage settings may remove or prevent access to locally saved entries.

You are responsible for the privacy and security of your device and browser profile. Mend cannot recover locally deleted entries.

9. Acceptable use

You may use the Services only for lawful, personal, non-commercial purposes unless Mend gives written permission otherwise.

You must not:

• copy, reproduce, redistribute, sell, sublicense, scrape, republish, or commercially exploit protected Mend content except where law permits;
• remove copyright, trademark, attribution, safety, or proprietary notices;
• present Mend resources as professional care, clinical treatment, certification, or medical advice;
• use Mend resources to provide unlicensed treatment or supervise another person's trauma processing;
• use automated systems to overload, probe, interfere with, reverse engineer, or bypass security or access controls;
• introduce malware or malicious code;
• attempt unauthorized access to systems, data, accounts, or administrative tools;
• violate law, infringe another person's rights, harass others, or create a foreseeable risk of harm;
• submit another person's sensitive information without a lawful basis and authorization; or
• impersonate Mend or falsely imply endorsement, partnership, licensure, or affiliation.

10. Intellectual property and license

Unless otherwise stated, Mend or its licensors owns the Services and their original text, design, videos, audio, graphics, software, worksheets, trademarks, trade dress, and other content.

Subject to these Terms, Mend grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your own lawful, non-commercial use.

Downloading, printing, saving, or purchasing a resource does not transfer ownership or grant a right to reproduce, distribute, resell, train models on, modify for redistribution, or create a competing derivative product unless Mend expressly agrees in writing or applicable law permits it.

Third-party names, marks, media, and materials remain the property of their respective owners.

11. Feedback and communications

Mend does not claim ownership of private worksheet entries that remain stored on your device.

If you voluntarily submit general product feedback, suggestions, corrections, or non-confidential ideas, you grant Mend a worldwide, non-exclusive, royalty-free right to use that submission to operate and improve the Services, subject to the Privacy Policy and applicable law.

This permission does not authorize Mend to publish identifiable health information, trauma histories, private communications, your name, image, testimonial, or personal story. Mend will seek separate permission before using identifiable material in marketing.

Do not submit content that you do not have the right to share.

12. Third-party services and links

The Services may link to or depend on third parties, including YouTube, Cloudflare, PostHog, Stripe, Google, Gmail, Google Forms, and Buy Me a Coffee. Future products may use additional hosting, payment, email, analytics, accessibility, or customer-support providers.

Third-party services have their own terms, privacy practices, security, and availability. Mend does not control their independent services. A link does not necessarily mean endorsement.

You are responsible for reviewing third-party terms before using those services. Mend remains responsible for its own representations and for obligations that applicable law does not permit it to exclude.

13. Email communications

Mend may require an email address and acceptance of the applicable session acknowledgement to provide access to certain guided sessions. Providing an access email does not by itself enroll you in promotional messages.

If you separately choose to join the Mend list, Mend may send the updates described beside the signup form. Marketing messages will include a reasonable way to unsubscribe.

After an unsubscribe request, Mend may retain the minimum information necessary to honor the request, comply with law, resolve disputes, or protect the Services.

Mend may send non-marketing messages needed to deliver a requested resource, confirm a transaction, respond to you, or communicate a material service, security, or policy issue.

14. Purchases, subscriptions, and renewals

If Mend offers a paid product or subscription, the checkout page will identify the product, price, currency, taxes or fees, whether billing is one-time or recurring, renewal timing, cancellation method, access period, and applicable refund terms.

By completing a purchase, you authorize Mend and the disclosed payment provider, currently Stripe for the provisional checkout, to charge the amount shown at checkout under the terms you accept there.

Paid Mend products remain educational and self-support resources. Payment does not create a clinical or professional relationship and does not purchase therapy, diagnosis, medical care, crisis support, or a guaranteed outcome.

15. Cancellations and refunds

Any product-specific cancellation or voluntary refund policy will be displayed before purchase. Mend will honor cancellation, cooling-off, refund, and consumer-remedy rights that apply and cannot legally be waived.

Requests concerning duplicate charges, unauthorized charges, non-delivery, or material technical failure should be sent through the Contact page promptly.

A refund limitation does not exclude remedies for misrepresentation, defective supply, or another right that applicable law does not permit Mend to waive.

16. Availability, preservation, and changes

Mend may maintain, update, suspend, restrict, replace, or discontinue all or part of the Services. Mend does not guarantee continuous availability, permanent storage, compatibility with every browser or device, or preservation of locally saved entries.

Where reasonably possible, Mend will provide advance notice of a material change affecting paid access. This section does not remove obligations to deliver purchased Services or provide remedies required by law.

You should retain your own copy of any information or resource you need to preserve.

17. Accessibility

Mend works to improve accessibility but does not claim that every resource is accessible to every person, device, browser, or assistive technology.

You may report an accessibility problem through the Contact page. Mend will consider reasonable alternatives where feasible and legally required.

18. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Services are provided on an “as available” and “as is” basis.

Mend disclaims implied warranties or conditions to the extent they may lawfully be disclaimed, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement.

Mend does not warrant that the Services will be uninterrupted, secure, accurate, complete, current, free of harmful components, or suitable for your particular needs.

19. Limitation of liability

To the maximum extent permitted by applicable law, Mend and its owners, officers, employees, contractors, contributors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising from or related to the Services, including loss of data, opportunity, revenue, or goodwill.

For a paid Service, and only to the extent permitted by law, Mend's aggregate liability concerning that paid Service will not exceed the amount you paid Mend for that Service during the 12 months immediately preceding the event giving rise to the claim.

For a free Service, liability is limited to the minimum amount permitted by applicable law. These limitations apply only after giving effect to mandatory rights.

20. Rights and liabilities that cannot be excluded

Nothing in these Terms excludes an express commitment Mend has made or a warranty, guarantee, duty, remedy, privacy right, or consumer right that cannot lawfully be excluded or limited.

Nothing excludes or limits liability where doing so is prohibited, including liability for fraud, intentional misconduct, or death or personal injury where applicable law prohibits limitation.

If local law gives you stronger rights than these Terms, those mandatory rights continue to apply.

21. Responsibility for unlawful or commercial misuse

To the extent permitted by law, you are responsible for reasonably foreseeable third-party claims, losses, and expenses arising from your unlawful commercial exploitation of Mend content, infringement of another person's rights, malicious interference with the Services, or deliberate material violation of the prohibited-use rules.

This section does not make you responsible for Mend's own acts or for liability that law assigns to Mend.

22. Suspension and termination

Mend may suspend or terminate access where reasonably necessary to address fraud, abuse, unlawful activity, intellectual-property infringement, security threats, non-payment, or a material violation of these Terms.

Termination does not erase accrued payment obligations or provisions that by their nature should survive, including intellectual property, warranty disclaimers, liability provisions, dispute terms, and privacy obligations.

Consequences for paid access remain subject to the checkout disclosures and mandatory consumer law.

23. Health claims, testimonials, and research

Mend aims to distinguish evidence concerning clinician-delivered EMDR from evidence concerning bilateral stimulation, digital guidance, preparation worksheets, educational content, or self-directed use.

References to research do not mean that a study tested the exact Mend resource or that results apply to every user. Research evolves and may contain uncertainty, limitations, conflicting findings, or population-specific results.

Testimonials, founder experiences, examples, and comments describe individual perspectives. They are not guarantees, clinical evaluations, or proof of a typical result.

24. Changes to these Terms

Mend may update these Terms to reflect product, legal, security, or operational changes. The effective date at the top identifies the current version.

Material changes will be communicated through an appropriate channel where reasonably possible or legally required. Continued use after a change takes effect constitutes acceptance only where applicable law permits that method of acceptance.

25. Questions and disputes

Please contact Mend first if you have a concern so the parties can attempt a good-faith resolution. This request does not prevent urgent relief, shorten a legal limitation period, or remove your right to contact a court, regulator, payment provider, or consumer authority.

Applicable law and forum depend on the legally responsible operator, your location, and mandatory consumer rules. These Terms do not select a jurisdiction in a way that deprives you of protections that cannot lawfully be waived.

26. General provisions

Severability

If a provision is held unlawful or unenforceable, it will be modified or severed only to the minimum extent necessary. The remaining provisions continue where legally possible.

No waiver

Failure to enforce a provision once is not a permanent waiver of that provision.

Assignment

You may not transfer paid access in violation of product-specific terms. Mend may transfer its rights and obligations as part of a legitimate reorganization, financing, merger, acquisition, or sale, subject to applicable law and continued protection of personal information.

Entire agreement and priority

These Terms, the Privacy Policy, checkout disclosures, and product-specific terms form the agreement for the Services. A more specific product or checkout term controls that subject when it conflicts with a general term, unless law requires otherwise.

Headings

Headings are for navigation and do not limit the meaning of a provision.
